FAQ: Title Loan Questions for Texas Residents

What happens if I miss a payment on my title loan in Texas?

Your car is the collateral, so it can be repossessed if you default. After default, a lender may repossess without advance warning but cannot breach the peace and must give reasonable notice before selling. If the sale brings less than you owe, you may still owe the difference.

Is a car title loan more expensive than other types of loans?

Yes. Title loans often come with high costs. Rate cap in Texas: No state cap on the credit access business fee. Our APRs go up to 150% and never exceed the cap set by state law.

Can I renew or refinance a title loan in Texas?

Under Texas law, no statutory refinance limit in Tex. Fin. Code ch. 393; refinancing is allowed but its added cost must be disclosed (§§ 393.222, 393.223).

Can I pay off my title loan early in Texas?

Yes. You can pay off your loan early at any time, and there is no prepayment penalty.

Where can I file a complaint about a title lender in Texas?

Contact the Texas Office of Consumer Credit Commissioner, which licenses title lenders in Texas. You can also use it to check that a lender is licensed before you sign.

Do title loan providers run a credit check?

No credit check is needed to pre-qualify. A soft credit check may be required as part of the final approval process. That does not affect your FICO score. Borrowers with bad credit are welcome to apply: we focus mainly on your ability to repay and your vehicle's value and equity, rather than your credit score alone.

Does my car’s condition influence how much I can borrow?

Yes. Your car's value sets how much you can borrow, and condition and mileage both affect that value. We usually lend 25% to 50% of your car's value, sometimes more. There is no mileage limit, and salvage or rebuilt titles can qualify with a lower appraisal. A car that doesn't run may still qualify, usually for less.

Can the title loan process be completed online in Texas?

Yes. The whole process can be done online, with no store visit required, and you keep driving your car while you repay. A GPS device is needed only in some cases, and you are told before you sign.
